This Privacy Policy describes how Culét Jewellery Pty Ltd (ABN 92 601 943 131) — referred to below as "Culét", "we", "us", or "our" — collects, uses, holds, and discloses your personal information when you visit or use www.culet.com.au (the "Site"), purchase from us, engage with our advertising, or otherwise communicate with us (together, the "Services").

We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and this Privacy Policy.

By using the Services you agree to our collection, use, and disclosure of your personal information as described here. If you do not agree, please do not use the Services.

  • Email and marketing platforms (Klaviyo) — email engagement (opens, clicks, unsubscribes) and identity data if you have subscribed via a form on our Site.
  • Shipping and logistics partners — delivery status and address confirmation.

2. How we use your personal information

  • Shipping and logistics providers
  • Fraud-prevention and security services

  • Business advisors and professionals — for example, our lawyers, accountants, and auditors, where necessary for legitimate business purposes.

  • Prospective or actual purchasers of our business — in connection with a sale, merger, or restructure.

  • Regulators or law enforcement — where we are required by law to disclose personal information (e.g. subpoena, court order, or valid law-enforcement request).

We do not disclose your personal information for direct-marketing purposes without your consent.


5. Overseas transfers of personal information

Some of our service providers (including Shopify, Klaviyo, Meta, and Google) store or process personal information outside Australia — in particular in the United States and the European Union. Where we transfer personal information overseas, we take reasonable steps to ensure the recipient handles the information consistently with the Australian Privacy Principles.

By using the Services, you consent to your personal information being transferred and processed outside Australia for the purposes described in this Policy.


6. Your rights

Under the Australian Privacy Principles you have the right to:

  • Access the personal information we hold about you.
  • Correct personal information that is inaccurate, out of date, or incomplete.
  • Request deletion of personal information we no longer need to hold (subject to legal record-keeping obligations).
  • Withdraw consent to marketing communications at any time — use the unsubscribe link in any marketing email, or reply STOP to any SMS.
  • Complain to us about how we have handled your personal information (see Section 10).

Opting out of personalised advertising

You can also control how third-party advertising platforms use your data:

  • Meta / Facebook / Instagram: manage your ad preferences at facebook.com/adpreferences
  • Google: manage your ad preferences at adssettings.google.com
  • Use your browser's Do Not Track or Global Privacy Control signal — we will treat this as a request to opt out of interest-based advertising to the extent required by applicable law.

7. Security and retention

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure — including encryption in transit (HTTPS), access controls, and vetting our service providers.

No security measure is perfect. If you become aware that your account has been compromised, please contact us immediately at sales@culet.com.au.

We retain personal information only for as long as needed for the purposes described in this Policy, or as required by law (for example, tax and consumer-law records are typically retained for at least seven years).


8. Children's information

Our Services are intended for adults. We do not knowingly collect personal information from children under 16. If you believe we hold information about a child, please contact us and we will take steps to delete it.


9. Changes to this Policy

We may update this Policy from time to time to reflect changes to our practices, legal obligations, or the technologies we use. When we make material changes, we will update the "Last updated" date at the top and, where required by law, notify you directly.
